  11. Receiving the draft settlement figures from the buyers conveyancer in readiness of settlement.
  12. Checking the draft settlement figures and advising the client and taking instructions for payment of the settlement sum.
  13. Attend to settlement.

These procedures must be carried out with timeliness and diligence so that delays are avoided. Generally a delay caused by a buyer will see the buyer penalised with a late settlement penalty.

WHAT IS MEANT BY EXCHANGE OF CONTRACTS

Both buyer and seller of a property become bound by the contract when the contract is exchanged. The procedure of exchanging contracts involves one contract being signed by the buyer of the property and the other being signed by the seller of the property; the buyer receives the sellers contract and the seller gets the buyer’s contract. Generally speaking there is no contractual relationship between the parties until the contract is exchanged and dated.

The final terms and conditions of the contract is generally negotiated by your lawyer or conveyancer before the exchange of contracts.
